Tims Camps 50/50 Official Rules of Play (“Official Rules”)

Ontario Raffle

 

1.       GENERAL.

The Tims Camps 50/50 Raffle (the "Raffle") allows Ontarians to participate in a fundraising initiative that supports providing youth from underserved communities in Ontario with life-changing Tim Hortons Foundation Camps experiences. For the avoidance of doubt, the Raffle is open only to persons who are located in the Province of Ontario at the time of entry and who are eighteen (18) years of age or older.

 

The Raffle is operated through an electronic system for the purchase of tickets and for generating, tracking, storing, and reporting on numbers associated with purchased tickets (the "System") and operated and maintained by a third-party vendor ("Bump Worldwide Inc." or “System Provider”). By participating in the Raffle, entrants agree to be bound by these Official Rules and by the decisions of the Tim Horton Children’s Foundation Inc. (the "Foundation"), which shall be binding and final as to all matters related to the Raffle. The Raffle is subject to all applicable federal, provincial, and local laws and is void where prohibited.

 

2.       JACKPOT & DRAWS.

The "Jackpot" for the Raffle shall be the total proceeds from Raffle tickets sold during the time period for the Raffle ("Raffle Tickets"). The amount of the Jackpot will be tracked by the System, and the amount will be regularly updated and publicly posted online at www.timscamps5050.ca. (the "Website").

 

There will be a 5050 prize draw (the "5050 Draw"), and three early bird prize draws (the "Early Bird Draw"), held in accordance with the draw period(s) set out in Section 5 below (the "Draw Schedule"). The campaign will have one (1) winner for each of the following draws: Early Bird Prize Draw #1, Early Bird Prize Draw #2, Early Bird Prize Draw #3 and the 5050 Draw. The Winners (defined below) of the Early Bird Draws will still be eligible for the 5050 Draw.

 

Tickets will only be valid for the Raffle Period indicated on the ticket and will not be valid for any other Raffle Period.

 

3.       EARLY BIRD PRIZES. 5050 PRIZE AND ALLOCATION OF PROCEEDS.

 

The prizes set out below are allocated to each Campaign and are run in accordance with the schedule set out under section 5.A. of these Official Rules. The term “Prize” means either or all of the 5050 Prize(s), and the Early Bird Prize(s), as the context may be.

 

The 5050 Prize

The Winner of the 5050 Draw for each Campaign will receive a cash prize equal to fifty percent (50%) of the final Jackpot amount for the 5050 Draw (the “5050 Prize”). The net funds (after expenses) will be used by the Foundation to support providing youth from under-served communities in Ontario with life-changing Tim Hortons Foundation Camps experiences. The minimum jackpot amount is guaranteed at $5,000, when the ticket sales exceed $10,000, the winning prize will be half of the sales.

 

Campaign Early Bird Prizes

 

Early Bird Prize #1 – Tim Hortons Coffee or Tea a Day for a Year Package - one (1) winner

The Winner of Early Bird Draw #1 will receive twelve (12) $100 Tim Hortons Gift Cards (to cover the approximate cost of 365 medium Tim Hortons brewed coffees (as of the contest start date).

Note: Medium brewed coffee pricing may vary by region and be subject to applicable taxes and fees, including but not limited to, single use packaging fees as mandated by local law. The approximate cost of one (1) medium brewed coffee is subject to change. Under no circumstances whatsoever will any difference between the ARV of the Prize and the approximate retail value of 365 medium coffees at the time of fulfillment (or any other time) be awarded.  

 

Early Bird Prize #2 – New York City Stay - one (1) winner

The Winner of Early Bird Draw #2 will receive a four (4) night stay for two (2) at a 5-star hotel in New York City between December 1, 2025, and November 1, 2026 (exact dates are subject to availability) and a $5,000 CAD cash prize (the "Early Bird Prize #2"). The cash prize portion of the Early Bird Prize #2 may be used at the Winner’s discretion, including to cover costs related to airfare, transportation to/from the hotel, meals, all incidentals (i.e., damages, spa charges, room service/mini-bar, phone calls, movies). Prize must be claimed in accordance with Section 8 of these Official Rules. All guest names will need to be provided to Tims Camps to allow for booking. The ARV is $10,000 CAD..

 

Early Bird Prize #3 – Tickets to Watch an NHL® Game and Meet Sidney Crosby - one (1) winner

The Winner of Early Bird Draw #3 will receive tickets for two (2) to attend an NHL® Game during the 2025/2026 Regular Season,  meet and greet with Sidney Crosby, and a $4,500 CAD cash prize which may be used at the Winner’s discretion, including to cover costs related to airfare, accommodations, transportation to/from the hotel, meals, all incidentals (i.e., damages, spa charges, room service/mini-bar, phone calls, movies) (the “Early Bird Prize #3). Prize must be claimed in accordance with section 8 of these Official Rules. All guest names will need to be provided to Tims Camps to allow for booking. The ARV is $5,000 CAD.

 

Without limiting the foregoing, the following general terms and conditions apply to all Prizes (as applicable): (i) all values set above are based on approximate prize values in Canada (in CAD) at the time of preparing these Rules, excluding taxes; (ii) all characteristics and features of each Prize, except as otherwise explicitly stated above, will be determined by the Foundation in its sole and absolute discretion; (iii) each Prize must be accepted as awarded and is not transferable, assignable or (as applicable) convertible to cash (except as may be specifically permitted by the Foundation in its sole and absolute discretion); (iv) no substitutions are permitted, except at the Foundation’s option and as may be specifically permitted by the Foundation in its sole and absolute discretion; (v) the Foundation reserves the right at any time to: (a) place reasonable restrictions on the availability or use of a Prize or any component thereof; and (b) substitute a Prize or a component thereof in case of unavailability, to accommodate for a disability, or for any reason, with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Foundation’s sole discretion, a cash award; (vi) Prize winners are solely responsible for all costs not expressly described herein (including, without limitation, if a Prize includes any travel, dining, entertainment or other experience/events, any costs and expenses associated with acceptance and use of the Prize not specifically mentioned herein as being provided are the sole responsibility of the winner, including but not limited to, incidental charges, luggage fees, meals, gratuities, spending money, and costs associated with obtaining travel documents (including, but not limited to passports and visas); (vii) redemption of each Prize must occur within and/or on or before the date or dates specified by these Official Rules (otherwise the Prize may, in the sole and absolute discretion of the Foundation, be forfeited in its entirety and, if forfeited, nothing will be substituted in its place); (viii) if the confirmed winner does not utilize any part(s) of the Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Foundation, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (ix) by accepting a Prize, each confirmed winner acknowledges that the Released Parties have not made, offered nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any Prize, including but not limited to its quality, authenticity, merchantability, mechanical condition or fitness for a particular purpose in connection with the 5050 Draw or any Prize; (x) any and all warranties and/or guarantees on a Prize (if any) are subject to the respective manufacturers’ terms therefore, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee; (xi) all taxes and mandatory fees are the sole responsibility of the confirmed winner, as applicable - without limiting the foregoing, all approximate retail values do not include applicable goods and services tax, provincial, territorial or sales and use taxes, or mandatory levies, duties or other fees (for example, applicable environmental fees), confirmed winners may be required to pay such taxes or fees upon receipt of the applicable Prize; (xii) the Released Parties will not be in any way responsible (and for greater certainty, the Prize may be forfeited and the Sponsor is not obligated to offer any substitute prizing in its place) in the event that any part of a Prize (including without limitation, delivery) is delayed, postponed, rescheduled or cancelled for any reason whatsoever beyond the commercially reasonable control of the Released Parties (including, without limitation, due to illness or health risks, or any governmental or health authority orders, measures, directives or guidance in response to such illness or risks, such as, without limitation, those that may be implemented to mitigate COVID-19 transmission); (xiii) by accepting a Prize, each confirmed winner agrees to waive all recourse against the Released Parties if the applicable Prize or a component thereof does not prove satisfactory, either in whole or in part; (xiv) any difference between the actual value of a Prize and its stated ARV will not be awarded (including, as applicable and without limitation, any difference between the actual value of a Prize in USD at the time of fulfillment and its stated ARV in CAD above calculated based on the current exchange rate at the time of preparing these Rules); (xv) expiry dates provided herein are subject to change within the Foundation’s sole and absolute discretion; (xvi) Prizes are awarded “as is”; (xvii) Prize details and availability are subject to change; (xviii) each Prize is subject to terms, conditions, expiration dates, and restrictions imposed by the applicable supplier of the prize or components thereof or issuer in the case of event tickets, gift cards, or other instruments; (xix) Prizes may not be exactly as shown in promotional materials; (xx) if applicable, the confirmed Winner and their guest must be in possession of a valid passport and other necessary travel documents upon selection, which documents must be valid prior to, and for the duration of the trip – failure to obtain necessary travel documentation will result in forfeiture of the prize; and (xxi) by participating in a Prize (as applicable) the winner and as applicable, their guest (and, as applicable, if a potential Prize winner’s guest is a Minor, their parent or legal guardian): (a) signifies that they understand, acknowledge and accept that participation in the Prize may involve danger and/or exposure to risks and hazards (including without limitation as may be due to the inherent risks of travel and as may be due to possible COVID-19 exposure or infection), whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, they may suffer damage to personal property, serious personal injury, illness or even death; (b) signifies that they acknowledge and agrees that the Released Parties have not made any warranties, guarantees or representations about the participant’s safety while participating in the Prize; (c) warrants and represents that they have evaluated the nature, scope, and extent of the risks involved, and freely and voluntarily agree and assume any and all such risks arising out of or connected with the participant’s participation in the Prize; and (d) agrees the participant will participate in the Prize in a respectable manner and abide by all applicable participation or venue policies, as applicable (the Foundation reserves the right to revoke any component of the Prize from the winner or winner’s guest who it, or applicable venue personnel, deem in their sole discretion as a safety risk, having violated any applicable policy or law, or may be bringing the Foundation or any of the other Released Parties into disrepute, and for greater certainty, nothing will be substituted in place of any revoked Prize component).

 

4.       ELIGIBILITY.

The Raffle is open only to persons who are located in the Province of Ontario at the time of entry and who are eighteen (18) years of age or older and otherwise meet the conditions specified in these Official Rules.

Notwithstanding the foregoing, the following individuals shall be ineligible to win a Prize:

 

i.             Any person directly involved in or responsible for selecting the Winning Number;

ii.             Employees, interns and Board of Directors of Tim Horton Children’s Foundation Inc.

iii.           TDL Group Corp. employees

iv.             Employees of Bump Worldwide Inc. and its affiliates (including Canadian Banknote Company, Limited)

v.             Members of the same household, (whether or not related) of any of the above (i - iv).

 

5.       PURCHASING TICKETS & DRAW DATES.

A.      Draw Schedule

The 5050 Draw and Early Bird Draw (each a “Draw”) will take place at Tim Hortons Foundation Camps Home Office (264 Glen Morris Rd East, St. George, ON N0E 1N0) in accordance with the following schedules:

Campaign

The Campaign consists of the following prizes: a 5050 Grand Prize with a guaranteed prize of $5,000 (when the ticket sales exceed $10,000, the winning prize will be half of the sales) and three Early Bird Prizes. Early Bird Prize #1 is one (1) Tim Hortons Coffee or Tea a Day for a Year Package (12 x $100 Tim Hortons Gift Cards – Early Bird 1), Early Bird Prize #2 is a four (4) night stay for two at a 5-star hotel in New York City and $5,000 cash (Early Bird 2). Early Bird Prize #3 is Tickets to Watch an NHL® Game and Meet Sidney Crosby and $4500 cash (Early Bird 3). See Section 3 above for full prize details.

 

·       Ticket Sales Launch – Monday, September 8, 2025

·       Early Bird 1 Deadline – Wednesday, September 17, 2025 (11:59pm EST)

·       Early Bird 1 Draw – Thursday, September 18, 2025 (1:00pm EST)

·       Early Bird 2 Deadline – Tuesday, September 23, 2025 (11:59pm EST)

·       Early Bird 2 Draw – Wednesday, September 24, 2025 (1:00pm EST)

·       Early Bird 3 Deadline – Wednesday, October 1, 2025 (11:59pm EST)

·       Early Bird 3 Draw – Thursday, October 2, 2025 (1:00pm EST)

·       Ticket Sales Close – Sunday, October 5, 2025 (11:59pm EST)

·       Grand Prize Draw – Monday, October 6, 2025 (1:00pm EST)

 

If the System or Payment Processor experiences any technical difficulties during the Raffle, the Early Bird Draw Period, the Grand Prize Draw Period or a Draw or in the event virus, bugs, unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the Raffle (or any portion thereof), the Foundation reserves the right, pending the Alcohol and Gaming Commission of Ontario ("AGCO") approval to (i) cancel or modify the Raffle, a Draw, the Early Bird Draw Period, or the Grand Prize Draw Period; (ii) suspend the Raffle, a Draw, the Early Bird Draw Period, or the Grand Prize Draw Period until the problem can be remedied, whereupon it will resume. Without limiting the generality of the foregoing, in the event of a cancellation, modification or suspension, the Foundation reserves the right, pending AGCO approval, to elect to identify a Winner and award the Prize byway of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation, modification or suspension.

 

In the event that the System is unavailable at the time a Draw commences or for a substantial portion of the Early Bird Draw Period or the Grand Prize Draw Period, due to technical difficulties

or otherwise, the Foundation will notify AGCO and may elect to cancel or amend the dates for a Draw, the Early Bird Draw Period, or the Grand Prize Draw Period, pending AGCO approval.

B.     Purchasing Raffle Tickets

Raffle Ticket Packages may be purchased as follows: Tims Camps 5050 (3) Numbers for $10; Tims Camps 5050 (25) Numbers for $25; Tims Camps 5050 (100) Numbers for $50; Tims Camps 5050 (500) Numbers for $100. Unless otherwise stated in this section, there is no limit to the number of Raffle Tickets an individual may purchase.

Raffle Tickets will be available for purchase as follows:

 

(A)         Online.

a.          Visit www.timscamps5050.ca where the rules and cause of the 50/50 Raffle are explained. The button that says "Buy Tickets Now" will take you to the purchase portal section of the page.

b.          In the purchase portal section, you must:

i.     Confirm your location by allowing your device to access geo location services

ii.     Select how many Raffle Tickets you wish to purchase.

iii.    Confirm eligibility to purchase; agree to the Raffle terms and conditions.

iv.     Enter your contact name, email address and other details requested in application form ("Application Form") NOTE: The individual listed in this section of the Application Form will be presumed to be the rightful owner of the Raffle Ticket(s). Ensure the contact name matches the name on your government issued identification as you may be required to present this to claim a Prize.

v.      Enter credit card & billing information as required by Payment Processor

vi.    Confirm purchase.

c.            If the transaction is approved, you will receive a confirmation message with order ID on the webpage. An email confirmation will be sent to the email address listed in the Application Form, with order ID, product description and payment information.

d.          A secondary email (shipping confirmation) will be sent including all of the information in the confirmation e-mail along with the Raffle Ticket(s) containing their raffle Number(s). It can take several hours to receive the e-mail shipping confirmation.

e.           You are required to enter your e-mail address correctly with no errors when purchasing to ensure you receive your Raffle Ticket(s) and should check your spam and junk mail folders if you have not received your ticket(s) by 12:00 pm /noon (EST) the day after your Raffle Ticket purchase.

f.            If you have not received your ticket(s) by 12:00 pm/noon (EST) the day following the purchase, it is your responsibility to e-mail lottery@timscamps.com the day following the purchase to determine if the purchase was completed and if so, request that your ticket(s) be resent.

g.           You must e-mail from the same e-mail listed in the Application Form used to purchase the Raffle Ticket(s).

h.           Any emails sent to lottery@timscamps.com after 12:00 pm/noon (EST) the day following the 50/50 Raffle Draw Date to request that their ticket(s) be resent will not be processed.

 

(B)        Entrants purchasing Raffle Tickets online must fully complete their purchase by entering the required information and using the procedures specified. All Raffle Ticket purchases are subject to and will be treated in a manner consistent with the Website, the third-party payment processor Shopify Payments ("Payment Processor") and Bump Worldwide Inc. (“System Provider”) terms of use and privacy policy.

(C)         Individuals are solely responsible for ensuring that they receive the correct ticket denomination and solely responsible for the handling of the purchased ticket after the System and/or authorized ticket seller has issued the ticket.

 

6.       PERSONAL INFORMATION.

All personal information required in the Application Form to participate in the Raffle, enter a Draw, or purchase a Raffle Ticket (including your name and contact information) is collected by the Foundation, the System Provider and Payment Processor for the purposes of administering the Raffle and as otherwise set out herein, on the Website, and on the respective Payment Processor and System Provider websites. In addition, any such personal information collected may be used by the Foundation for the following purposes: to comply with legal, regulatory, and audit requirements; for communicating with participants; for announcing winners; for awarding Prizes; for disclosure of insider wins for public scrutiny; for the posting of Prize wins on the Website or other Foundation platforms for an extended period of time’ and for the Foundation’s internal business purposes. By providing your information, you consent to it being used for these purposes. Please see the Foundation’s privacy policy at https://timscamps.com/privacy-policy/ for additional information regarding our privacy practices.

Each Prize claimant acknowledges that the Foundation may, at any time (and from time to time), during the Prize claim process, request certain additional personal information from the Prize claimant (including, in certain circumstances, the Prize claimant's driver’s license). Each Prize claimant further acknowledges that any failure by the Prize claimant to provide the Foundation with such information may prevent the Foundation from paying or awarding all or part of the Prize in the manner contemplated.

The Foundation will not send you marketing communications unless you give the Foundation permission to do so. If you sign-up to receive marketing communications from the Foundation, you can unsubscribe at any time by clicking the “Update Email Preferences” link included at the bottom of each email. Alternatively, you can opt-out of receiving email marketing communications by contacting the Foundation at the contact information provided below. Please note that you may continue to receive transactional or non-marketing communications from the Foundation.

7.       SELECTION OF WINNING NUMBER.

Upon the conclusion of the Early Bird Draw Period and the Grand Prize Draw Period, the winning Number (the "Winning Number") will be selected using a Random Number Generation ("RNG") system from all Numbers sold for that Draw. A Draw Announcement will be made by Tim Horton Children’s Foundation Inc. at a time and on a platform to be announced by Tim Horton Children’s Foundation Inc. on the Website. Immediately after the Draw Announcement, the Winning Number will be listed on the Website.

 

8.       PRIZE CLAIM.

Subject to meeting the requirements set out in this section, the individual listed as the "contact" in the Application Form for the Winning Number for a Draw will be considered the winner of that Draw (the "Winner"). Prize claimants who fail to meet all the requirements set out in this section will forfeit the Prize and another Winning Number will be selected.

 

Each Prize must be claimed by the Winners, within six (6) months of the applicable Draw, by contacting the 50/50 office at the email or telephone number indicated below, unless otherwise specified by the Foundation thereafter. In the event that a Winner does not claim a Prize, then they will be disqualified (and will forfeit all rights to the Prize) and the Foundation reserves the right in its sole and absolute discretion, to either award forfeited Prizes to the next eligible Winner, or decide whether forfeited Prizes will be donated to the Foundation , with the approval of the AGCO or as otherwise directed by the AGCO.

 

Each Prize claimant must provide the Foundation with all information required by the Foundation and/or provincial gaming regulations to demonstrate they are the Winner and claim the Prize, which may include providing government issued identification. In order to receive the Prize, the Prize claimant will also be required to sign a Declaration and Release ("Release") which must be executed and returned to the Foundation no later than five (5) business days after his/her receipt of the Release.

 

The Foundation reserves the right to satisfy itself as to the validity of any ticket that is presented as a Winning Number, by means of such authentication and validation tests, requirements and procedures as it may from time to time determine, and to declare that a ticket which does not pass, meet, or fulfill such tests, requirements or procedures is void.

 

All Prizes will be sent to the Winners via email, mail or courier (as determined by the Foundation) within thirty (30) days of the Foundation confirming the prize claimant as the Winner. For security and safety reasons, no cash payments will be made to the Winners.

 

For groups purchasing a Raffle Ticket together, groups must select one individual to handle the

purchase; provided, however, that in the event of a dispute over ownership of the Winning Number, the individual listed in the Application Form for the Winning Number, will be presumed to be the Winner. The Foundation shall have no responsibility to any other person who claims any interest or right to receive all or any part of the prize associated with a Winning Number.

 

9.       ODDS.

The odds of winning a Draw depend on the number of Raffle Tickets purchased for each Draw.

 

10.   TRANSFER OF RAFFLE TICKETS.

Raffle Tickets are non-transferable. The individual listed as the "contact" in the Application Form will be the presumed owner of the Raffle Ticket. Purchasers of Raffle Tickets may not re-sell their Raffle Tickets to other parties and may not give Raffle Tickets away to others. All Raffle Tickets which have been given away or resold in violation of these Official Rules shall be void. All individuals who re-sell, purchase, or receive Raffle Tickets in violation of these Official Rules shall be ineligible to participate in the Raffle or to win a prize.

 

11.   RELEASE OF LIABILITY.

By entering into the Raffle, all entrants agree to: (a) be bound by these Official Rules; (b) be bound by the System Provider and Payment Provider Terms and Conditions and (c) release the Foundation, Restaurant Brands International, Inc., The TDL Group Corp., Bump Worldwide Inc. and its affiliates including, Canadian Banknote Company, Limited, any Draw promoter and any presenting partner of the Raffle, and each of their respective partners, subsidiaries and affiliates, together with the owners, employees, officers, directors, sponsors, volunteers and agents of any of the foregoing (collectively, "Released Parties") from and against any and all claims, demands, injuries, losses and liabilities whatsoever arising out of or connected in any way to the Raffle. The Foundation will administer the Raffle in good faith and in the best interests of the charitable beneficiaries but shall not have any liability in connection with any decisions made in connection with the Raffle. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any Prize (or any portion thereof); and (ii) disclaim any implied warranty. the Foundation failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

 

12.   PUBLICITY RELEASE.

Each Winner, by accepting a Prize, grants the Foundation, Restaurant Brands International, Inc., The TDL Group Corp., Tim Hortons Advertising and Promotion Fund (Canada) Inc., Tim Hortons USA Inc., The Tim’s National Advertising Program, Inc., their affiliated or related entities, and their advertising and promotional agencies. and the Released Parties full permission, except where legally prohibited, to use such Winner's name, address (city only), image, voice and/or other likeness, and Prize information for advertising, trade and promotional purposes without further compensation and without notice, review or approval, in all media now known or hereafter discovered, worldwide and in perpetuity. Each Winner shall execute all documents that the Foundation may require to be signed in connection with this release.

 

13.   RAFFLE TICKETS ARE NOT TAX DEDUCTIBLE.

Under current applicable law, amounts paid for chances to participate in raffles, lotteries, or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution.

 

14.   REFUNDS.

Requests for refunds will be assessed on a case-by-case basis and will be granted only in exceptional circumstances. Ticket purchases are non-refundable after the associated grand prize draw has occurred.

 

15.   GENERAL CONDITIONS.

The Foundation reserves the right to modify these Official Rules at any time, pending AGCO approval. Entries/Raffle Tickets which are or appear to be tampered with are void. Entries/Raffle Tickets generated by a script, macro or other mechanical or automated means will also be void. The Foundation shall be the sole judge of the validity and eligibility of all entries. Released Parties are not responsible for stolen, lost or mutilated Entries/Raffle Tickets; or for lost, interrupted or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, app, or other connections including those through and/or by any website or app, availability or accessibility or miscommunications or failed computer, satellite, cable or wireless transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; any error, omission, interruption, defect or delay in transmission, processing, or communication; non- delivery; misdirected, blocked, or delayed notifications; printing, typographical or other errors appearing within these Official Rules, in any Raffle-related advertisements, promotions or other materials; or any other errors, problems or difficulties of any kind whether human, mechanical, electronic, network, computer, telephone, mail, typographical, printing or otherwise relating to or in connection with the Raffle, including, without limitation, errors or difficulties which may occur in connection with the administration of the Raffle, the processing of entries, the announcement of the prize or in any Raffle- related materials, or the cancellation or postponement of any game, event or exhibition. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Raffle. Released Parties are not responsible for injury or damage to entrants' or to any other person's computer related to or resulting from participating in the Raffle or downloading materials from or use of the Website. The Foundation shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Raffle, and to resolve all disputes in its sole discretion.

 

16.   GOVERNING LAW.

The Raffle and these Official Rules shall be subject to and governed by the laws of the Province of Ontario. If a court of competent jurisdiction finds that any provision of these Official Rules, or their application to a particular person or circumstance, is invalid or unenforceable to any extent, then the

remainder of these Official Rules shall remain enforceable to the fullest extent permitted by law. The venue for any cause of action arising out of the Raffle or these Official Rules shall be located in Toronto, ON.

 

17.   CAUTION:

Any attempt to deliberately damage or interfere with the Website, the System, the Payment Processor or any website, email account or social media site associated with the Raffle or undermine the content or legitimate operation of the Raffle may be a violation of criminal and civil laws and should such an attempt be made, the Foundation will disqualify any entrant responsible for the attempt, and the Foundation and its agents reserve the right to seek damages (including attorneys' fees) and other remedies from any person or persons responsible for the attempt to the fullest extent permitted by law.
